As challenges and threats proliferate in cyberspace, public and private sector Internet users must adapt to changes in both the cyber security and regulatory environments. For commercial actors in particular, vulnerabilities such as Heartbleed and last year’s breaches into the information systems of major U.S. retailers highlight the threats and costs, and underscore the need to understand the security and regulatory requirements. Consequently, legal practitioners who counsel clients on cyber matters must be able to provide support in two broad categories: the proactive and the reactive. Proactive efforts include translating federal and state laws and regulations as well as industry standards into cost-effective practices that mitigate risks. NIST’s “Framework for Improving Critical Infrastructure Cybersecurity” is an important proactive measure in which legal practitioners may guide clients toward implementing appropriate policies and procedures to protect against cyber vulnerabilities and threats. On the reactive side, data breaches may trigger various federal and state reporting requirements, while raising serious concerns about reputational risk and criminal investigations. Please join us as our expert panel examines these issues, and translate them into practical guidance for practitioners.
